euqai provides AI solutions with a focus on compliance, privacy, and energy efficiency. Our services include access to generative AI capabilities through our application Quizi or via our API.

3. Beta Status Disclosure

Our service is currently in beta stage. While we strive to provide reliable services, you acknowledge that:

• Features may change without prior notice
• The service may experience interruptions or downtime
• Performance and capabilities may vary as we optimize our systems

4. AI Limitations and User Responsibilities

4.1 AI Capabilities and Limitations

Our AI services utilize advanced generative AI technology that:

• May produce incorrect, incomplete, or misleading information ("hallucinations")
• Can generate different responses to similar inputs
• Has limitations in factual accuracy and current information

4.2 User Responsibilities

You agree to:

• Not use our services for critical applications without appropriate human verification
• Exercise judgment when using AI-generated content
• Not rely on our services for legal, medical, financial, or other professional advice
• Comply with the EU AI Act and other applicable regulations when implementing our services

5. Account Registration and Security

You must:

• Provide accurate information when registering
• Maintain the confidentiality of your login credentials
• Notify us immediately of any unauthorized access
• Be at least 16 years old or have parental consent

6. Acceptable Use

You agree not to use our services to:

• Violate laws or regulations
• Infringe intellectual property rights
• Harass, abuse, or harm others
• Generate harmful, illegal, or unethical content
• Reverse engineer or attempt to extract our AI models
• Attempt to bypass usage limitations or security measures

7. Intellectual Property

7.1 Our Intellectual Property

The euqai platform, including software, design, and underlying technology, is owned by euqai bv and protected by intellectual property laws.

7.2 Content Ownership

You retain full ownership of your input data. We only process this data as necessary to provide you with our services and as explicitly requested by you. Any processing of your input data is performed solely to deliver the functionality you've requested and to maintain service quality, always in accordance with our Privacy Policy and in compliance with the GDPR. We make no claim to ownership or usage rights beyond what is required to fulfill our service obligations to you.

8. Credit System and Payment Terms

8.1 Credit System

Our services operate on a credit-based system:

• Credits must be purchased through our website
• Usage of our services deducts from your available credits
• Credits have no monetary value and cannot be exchanged for cash
• We reserve the right to modify the credit cost of services

8.2 No Refunds

Credits purchased are non-refundable. Please consider your needs carefully before purchasing credits.

8.3 Payment Processing

• Payments are processed through trusted third-party payment processors (Mollie or PayPal)
• We do not store your complete payment information
• All payments are subject to verification and approval

9. Service Termination and Account Suspension

9.1 Termination by Us

We reserve the right, at our sole discretion, to:

• Suspend or terminate your access to our services
• Disable your account
• Remove or discard any content within the service

This may occur without prior notice or liability if we determine you have violated these Terms, engaged in illegal activities, attempted to hack our systems, or otherwise abused our services. No refund will be provided for unused credits in such cases.

9.2 Termination by You

You may stop using our services at any time. Termination of your account does not entitle you to a refund for unused credits.

10. Limitation of Liability

To the maximum extent permitted by law:

• We provide services "as is" without warranties
• We are not liable for indirect, consequential, or punitive damages
• Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim

12. EU AI Act Compliance

We develop and provide our AI services in compliance with the EU AI Act. We are committed to:

• Transparency about the capabilities and limitations of our AI systems
• Risk management and mitigation for potential harmful effects
• Human oversight and intervention when necessary
• Maintaining appropriate technical documentation
• Ensuring data quality and governance

13. Changes to Terms

We may modify these terms with reasonable notice. Continued use after changes constitutes acceptance of the modified terms.

14. Governing Law

These terms are governed by Dutch law, without regard to conflict of law principles. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in the Netherlands.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
